Emergency authorisations

“Emergency authorisations”: applications for derogations in accordance with Article 55(1) of BPR

An official authorisation must be obtained before a biocidal product may be placed on the market. This does not apply to biocidal products containing existing active substances for which an approval decision is still pending. These may be made available on the market according to national transitional provisions (see product marketability).

Authorised products must contain an active substance from an approved source (see Article 95 - list). 

Under certain conditions, the authority may grant derogations and permit the limited and controlled use of a product under the supervision of the competent authority, if this is necessary due to a risk to public health, animal health or the environment that cannot be contained by other means. This is stated in Article 55(1) of Regulation (EU) No 528/2012 (BPR).
